Even if you do not see yourself suing everyone around for trademark infringement, this story means two things. First, you have to be a lot more careful when choosing the brand for your business. Chances are, it may already be taken. Or something similar to what you're thinking about may already be taken. Second, if you do manage to come up with a brand that is not taken, you must immediately take steps to secure it. Just because a brand is available today doesn't mean it will be available tomorrow. Just because you can get away with using a brand while nobody has heard of you, doesn't mean you will be able to continue using the brand as you start seeing the first signs of success. And yes, if you see someone ripping you off, do something about it.
