Trademark News & Screw-ups A SUPREME COURT RULING HAS OPENED THE FLOODGATES TO A STREAM OF GROSS TRADEMARKS

Great research on what used to be considered scandalous, immoral and disparaging trademarks—with some pretty tasty examples. We have actually had to turn several clients down as their trademarks weren't trademarkable because of this rule that is now gone. I've always said that it's not the role of the government to legislate morality. As long as it doesn't violate individual rights (and "not being offended" is not one of them), the government should let the free market decide whether a particular disparaging brand has any value.
