Trademark News & Screw-ups Bank Of America Faces Trademark Suit Over Virtual Banking Assistant Erica

With no federal trademark registration for "E.R.I.C.A." the plaintiff is facing a very expensive uphill battle. BOA, in turn, does have a federal registration for "Erica" that covers computer software for financial information management featuring voice command and recognition software, as well as a platform as a service featuring computer software platforms for personal assistant software. This registration by Bank of America is currently being challenged by the plaintiff. The plaintiff appears to have a state trademark registration in the state of Georgia for E.R.I.C.A. It will be interesting to see if this will be quietly settled with the plaintiff making more in this deal than he would ever have made if BOA happened to choose a different name or whether we'll actually see a battle between state marks, federal marks, a battle between Erica and E.R.I.C.A., as well as the battle between BOA and a tiny Colorado corporation nobody's ever heard of.
