The decision is not about whether there is infringement "without use." It's about whether removing the trademark from someone else's products constitutes use, which, in turn, may constitute an infringement. Court of Justice of the European Union has answered this latter question with a YES. Here's the lesson we can draw from this case: don't mess with others' trademarks.
