Trademark News & Screw-ups Cold case: Stone's trademark infringement claim against MillerCoors is only moderately strong

"Moderately strong" does not mean "is likely to face serious issues." What it means is that it's not clear-cut enough for the court to grant a preliminary injunction. MillerCoors is not going anywhere. It won't disappear or hide its assets. It might be able to come up with some sort of a legal argument, however plausible. If MillerCoors fails to convince the court that there is NO infringement, they will certainly be able to deliver on whatever judgment the court may award in favor of Stone Brewing Co. Preliminary injunctions are difficult to get, especially if there is no risk of the other side's assets vanishing into thin air. One thing I do agree on is that it would be a very interesting case to follow.
