EU Trademarks Office (EUIPO) will not refuse new trademark applications even if they are identical to other previously applied-for or registered trademarks. It will not notify the owners of such pre-existing marks. This is because the European trademarking system relies on owners of such pre-existing marks opposing new trademark applications. Unfortunately, only a small percentage of owners of EU trademarks consistently monitor newly filed trademark applications and, therefore, neglect to start opposition proceedings. This is, of course, a totally different story when the new application is filed by a celebrity. No wonder Conor is now dealing with oppositions on pretty much everything he files. The lesson here is to be very strategic and file your trademark applications early and quietly.
