As Beyonce recently learned, the only problem with trademarking babies' names is the risk of trademark cancellation for non-use. In other words, if a trademarked brand has not been actively used by the trademark owner, any interested person may request that the registered trademark is canceled. This is called clearing out the deadwood. The reason behind it is that trademarks are not meant to be hoarded, they are meant to help the market tell products and services of one vendor from identical or similar products and services of everyone else. Trademarks are not about who came up with the name first. Trademarks are about your genuine intention to use the trademark to identify your products and services.
