Trademark News & Screw-ups Eminem's Latest Battle Is Over E13 Clothing Line Trademark

What's really curious here is that Eminem successfully opposed an application for THREE 1 THREE citing his earlier E13 application, but now he's finding himself the target of an opposition from an even earlier trademark THREE THIRTEEN. It's also curious that USPTO examiners apparently did not find that either of these three brands was confusing to each other until their respective applicants opposed the other marks. It all boils down to Detroit's area code, 313. There are really a LOT of ways you can write this up— and unless the examiner is aware of the connotation, they'll let the application through, so it becomes the duty of brand owners to monitor newly filed trademark applications and oppose them, which is what is happening in this case. Now, who else thinks the parties are going to settle and find a way to coexist?
