Trademark News & Screw-ups Equinox's Hotel Venture Challenged by Trademark Lawsuit

Trademarks don't give you a monopoly over the name itself. They give you a monopoly over the mental association between your brand and the products and services you offer under your brand. This often means that the same name can be successful trademarked by two (or more) completely different companies—as long as they offer completely different products and services. The problems can start, as it did in this case, when one of the companies decides to expand its operations to start offering products and services that are similar to those trademarked by someone else. Given that both companies have deep pockets, it will be interesting to see how this dispute plays out.
