While it will eventually boil down to the question of whether enough Americans know that Inter in soccer relates to Inter Milan, at the current stage of the opposition process, Inter's attorneys made a great point. You can only claim that an applied-for trademark should not be registered on the basis of likelihood of confusion if you have a prior right to the mark you are trying to challenge. And you must specifically plead that in your statement of opposition. It will be interesting to see how this one plays out.
