Yet another reason to lift the ban on trademarking marijuana brands. I've not smoked a joint in my life, so I don't really care one way or the other about whether marijuana is legalized. But to the extent that some states allow its sale, it's insane to deprive producers of what is at least partially lawful of the opportunity to secure their brands. Legal uncertainty around brand protection for cannabis brands does not protect the public. It actually hurts both categories of people that trademark laws are designed to protect. It hurts consumers because they don't know if what they're buying is legitimate and it hurts producers who cannot protect the goodwill of their brands.
