Trademark News & Screw-ups Ohio State University is trying to trademark the word 'The' for merchandise

This demonstrates really well what trademarks can and cannot do. Here are my thoughts on this: 1. Can Ohio State legally USE "THE" as their brand? Probably, yes. 2. Can Ohio State successfully REGISTER "THE" as their trademark? Possibly. 3. Can Ohio State successfully ENFORCE "THE" as their trademark against others if they succeed at registering it? Very unlikely. At best, the trademark would allow them to go after literal copying specifically designed to target Ohio State. But it would not allow them to stop others from using the word "The" as part of other brands.
