Trademark News & Screw-ups Oprah Winfrey wins "Own Your Power"™ trademark suit

To be clear: while technically it's a win for Oprah, the Court of Appeals' decision means that no one owns the phrase "Own Your Power" because it would be merely descriptive of the plaintiff's business. That's sometimes the danger of trademarking taglines that mimic regular phrases: you may get them trademarked but it may be difficult to enforce them against others—especially if they have very deep pockets.
