Trademarks are not just about the name or the logo. They can also be about the overall way the packaging looks like. If consumers are likely to mistake a product of one company for an identical or a similar product of another company, you have a clear case of likelihood of confusion, which is what trademark infringement lawsuits are all about. Of all companies, the last one you want to copy from is a company that is notorious for diligently litigating over its IP.
