How many times can you step on a rake when coming up with a name for your restaurant? OK, first time, you didn't think much about it. You gave your restaurant the same name as the name that someone else had trademarked. You say it was a setback and you decided to come up with a new name. Understandable thus far. Where it stops making any sense is HOW you come up with a new name. All you do is you pick a name you like that you yourself think is "sufficiently different enough" from the trademark that already nailed you? Have you at least gotten their written consent to the new name? Have you at least done a proper trademark search for other similar names? Have you considered coming up with a name that nobody can take away from you down the road? Doesn't look that way. And that is precisely the attitude that will feed my Trademark Screw-Ups forever!
