Often, in order for the other side to pay attention to your demand letter, you need to actually sue them. Once they see you have a federal trademark AND that you've actually sued them, suddenly they start paying a lot more attention to your demands. Basically, that shows them that you are ready, willing, and able to enforce your trademark rights. But it all starts with you properly protecting your brand. Without it, you can't really do much.
